While Archer Travel provides accreditation, supplier access, and booking-platform support, DriftHaus Travel operates independently and is solely responsible for its branding, marketing, curated itineraries, communications, and client services. This affiliation does not create a joint venture, partnership, or employment relationship.

By accessing or using our website www.drifthaustravel.com and any related content, services, or features (collectively, the “Site”), you agree to these Terms.

1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. By using the Site, you represent that you are at least 18 years old (or the age of majority in your jurisdiction).

DriftHaus Travel curates and coordinates travel through a variety of third-party providers, including airlines, hotels, tour operators, transportation companies, cruise lines, travel insurers, and other suppliers (“Third-Party Providers”).

You acknowledge and agree that:

• DriftHaus Travel and Archer Travel do not own, operate, or control Third-Party Providers.

• All bookings with Third-Party Providers are subject to their individual terms, including cancellation, change, and refund policies.

• DriftHaus Travel and Archer Travel are not liable for the acts, omissions, errors, representations, warranties, breaches, or negligence of any Third-Party Provider, nor for personal injury, property damage, or other losses arising from their services.

You are responsible for reviewing all applicable Third-Party Provider terms and securing appropriate travel insurance.

4. No Professional Advice

Site content does not constitute legal, medical, financial, or tax advice. Consult appropriate professionals before making decisions in these areas, especially concerning vaccinations, visas, insurance, and travel documentation.

5. Intellectual Property, Logos & Branding

All original content and creative assets produced by DriftHaus Travel are owned by DriftHaus LLC, including but not limited to:

• The DriftHaus Travel and DriftHaus LLC names, logos, marks, and monograms

• DriftHaus-specific brand styling, color palettes, typography, imagery, and layout elements

• Custom-written travel copy, itineraries, descriptions, guides, and client-facing materials

• Images, photography, or graphics created or licensed directly by DriftHaus

• The distinctive look and feel of the DriftHaus brand as presented on this Site

These materials are protected under copyright, trademark, and trade-dress laws.

5.1 Use of Third-Party Platforms (Including Travefy)

DriftHaus Travel creates certain travel proposals, itineraries, and documents using third-party platforms such as Travefy.
Any system-generated templates, user interface elements, proprietary designs, or platform-owned assets within Travefy (or any other software) remain the intellectual property of their respective owners.

DriftHaus claims ownership only over the original copy, images, custom design choices, and brand elements we add to those platforms — not the platform itself.

Nothing in these Terms should be interpreted as:

• Suggesting that DriftHaus owns Travefy branding or platform materials

• Granting users rights to Travefy assets

• Modifying any licensing agreements governing the platforms we use

5.2 Permitted Use

You may view the Site and download a reasonable number of pages for personal, non-commercial use, provided you do not remove attribution or copyright notices.

5.3 Prohibited Use

Without prior written consent, you may not:

• Use DriftHaus trademarks, logos, or branding in a manner that implies endorsement or affiliation

By using DriftHaus Travel’s services, you agree that DriftHaus LLC (DBA DriftHaus Travel) is not responsible for any errors, omissions, acts, delays, or failures by third-party providers, nor for any losses, damages, or inconveniences arising from their actions or inactions.

DriftHaus Travel’s responsibility is limited to:

• Delivering the services we directly provide (e.g., planning, coordination, communication, research, and itinerary design), and

• Facilitating your bookings through reputable suppliers and platforms.

To the fullest extent permitted by law, any liability attributable to DriftHaus Travel shall be limited solely to the amount paid directly to DriftHaus Travel for the specific planning services rendered, and shall not include losses related to the performance or non-performance of third-party providers.

10. Indemnification

You agree to indemnify and hold harmless DriftHaus LLC (DBA DriftHaus Travel), its affiliates, employees, contractors, and Archer Travel (as applicable), from claims, damages, losses, liabilities, and expenses arising from:

• Your use of the Site

• Your violation of these Terms

• Your violation of any law or third-party rights

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

13. Governing Law & Arbitration Agreement

To promote a streamlined, efficient resolution process, you agree that any dispute, claim, or controversy arising out of or relating to your use of the Site, your interactions with DriftHaus Travel, or any travel services arranged through DriftHaus shall be resolved exclusively through binding arbitration, rather than in court.

13.1 Agreement to Arbitrate

You and DriftHaus LLC agree that:

• All disputes will be submitted to final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules.

• Arbitration will be conducted individually, and not as a class action, class arbitration, or any other type of representative proceeding.

• The arbitrator shall have the authority to resolve all disputes regarding the scope, enforceability, or applicability of this arbitration agreement.

13.2 Location

Unless both parties agree otherwise in writing, arbitration will take place in Los Angeles County, California, or virtually by video conference if more convenient for both parties.

13.3 Exceptions

Small claims actions that fall within the jurisdiction of a small claims court may be brought in small claims court instead of arbitration.
This does not allow for class or group claims.

13.4 Governing Law

The Federal Arbitration Act (“FAA”) governs the arbitration provisions of this agreement.
All other matters shall be governed by California law.

13.5 Waiver of Jury Trial

By agreeing to arbitration, you and DriftHaus Travel waive the right to a trial by jury and the right to participate in a class action.
